The ChatGPT Library and Europe’s Expensive War on Practical Innovation

OpenAI’s new Library for ChatGPT is, on paper, a small feature. In practice, it is one of those deceptively important pieces of product design that makes an AI system feel less like a parlor trick and more like infrastructure. According to OpenAI’s documentation, uploaded and created files are now saved to a dedicated Library, accessible from the left sidebar on the web, where users can browse, search, filter, download, and reuse documents, spreadsheets, presentations, PDFs, and images in later chats. OpenAI also says the feature is currently available to Plus, Pro, and Business users, but not yet in the European Economic Area, Switzerland, or the United Kingdom. 

That is the useful part, and it is genuinely useful. Anyone who has spent serious time working with ChatGPT knows the old ritual: upload a file, use it once, then later wonder which chat contained the spreadsheet, the PDF, or the presentation you actually needed. The new Library turns that mess into a reusable working set. It reduces friction. It lowers the cognitive tax of interacting with AI. It nudges ChatGPT away from disposable conversation and toward something closer to a persistent workbench. In product terms, this is not cosmetic. It is the difference between “toy” and “tool.”

And yet, because we live in the age of European self-sabotage, even this modest improvement arrives with a familiar asterisk: not for much of Europe.

This is the part where defenders of the European regulatory state usually clear their throats and begin reciting the liturgy of “rights,” “guardrails,” “trust,” and “responsible innovation.” Fine words. Splendid phrases. Nobody sensible is arguing for lawless deployment, reckless data abuse, or a Silicon Valley free-for-all. But Europe has developed a peculiar talent for taking a legitimate regulatory instinct and inflating it into a continental operating system of hesitation.

The result is not heroic consumer protection. The result is delay.

And delay, in technology, is not neutral. Delay is a market outcome. Delay is a product decision. Delay is a transfer of advantage to places where companies can actually ship.

This is not some feverish fantasy concocted by deregulation romantics. There is a visible pattern. Reuters reported in June 2024 that Meta halted the launch of its AI models in Europe after intervention from the Irish privacy regulator and complaints from advocacy groups; Meta itself warned that Europeans would receive a “second-rate experience” without the ability to use local information. Reuters also reported that Apple delayed the launch of several AI features in Europe, explicitly citing EU tech rules. 

The point is not that Meta and Apple are saints. They are not. The point is that large companies with armies of lawyers, lobbyists, and compliance officers increasingly look at Europe and conclude that the first question is no longer “Can we build something valuable there?” but “How much legal shrapnel will this attract?”

That changes behavior. It makes companies cautious. It makes product counsel more powerful than product managers. It makes regional launch plans read like battlefield maps. It makes “global rollout” mean “global, minus Europe, plus a footnote.” And it teaches younger firms the same lesson before they have even begun: keep your head down, say as little as possible, and launch elsewhere first.

Europe, meanwhile, congratulates itself on its moral seriousness.

There is a special irony in all this. The continent that once prided itself on engineering, science, industry, and institutional confidence now often behaves like a museum curator frowning at the future through protective glass. America builds a new machine, China scales it, and Europe drafts a consultation paper explaining why everyone should slow down until the proper committees have met.

Even the EU’s defenders tacitly admit the burden. The European Commission’s own guidance says obligations for providers of general-purpose AI models under the AI Act entered into application on August 2, 2025, with enforcement powers and fines following from August 2, 2026. Reuters reported in July 2025 that the Commission rejected calls from major U.S. and European companies to pause the rollout, while companies warned about compliance costs and heavy requirements. 

Again, one can support a legal framework in principle and still observe what is happening in practice. Businesses do not experience regulation as an abstract expression of democratic virtue. They experience it as paperwork, uncertainty, exposure, and asymmetric downside. If the upside of launching in Europe is a respectable subscriber base, while the downside is years of scrutiny, endless complaint mechanisms, and the possibility of large penalties, companies will rationally hedge. Some will delay. Some will trim features. Some will wall off data flows. Some will decide the juice is not worth the legal squeeze.

And then European politicians will stage another press conference about digital sovereignty.

One would think that a continent so anxious about strategic dependence might show greater urgency in becoming a place where advanced digital products can actually debut. Instead, Europe often seems determined to perfect a model in which it regulates technologies largely created elsewhere, then expresses dismay when those technologies arrive late, diminished, or not at all.

That is why the ChatGPT Library matters beyond its humble interface improvements. It is a small case study in a larger civilizational habit. The feature itself is sensible and overdue: of course users should be able to find, organize, and reuse the files they have already entrusted to a system. Of course an AI workspace should have memory in the practical, mundane sense of saved artifacts. Of course this makes the product better.

But in Europe, even the obvious now travels with a legal escort.

There is a deeper cost to this than inconvenience. It is not merely that European users wait longer for features. It is that they are trained to become consumers of second-wave technology rather than participants in first-wave experimentation. They are invited to enjoy innovation only after it has been sterilized, audited, filtered, translated into regulatory prose, and approved by people whose main exposure to software is often institutional rather than creative.

That is not how ambitious societies behave.

A confident political order should be able to distinguish between genuine abuse and normal product evolution. It should punish misconduct without constructing a general atmosphere of anticipatory fear. It should understand that innovation requires not only rules, but permission. Europe increasingly offers rules without permission, scrutiny without speed, and standards without appetite.

So yes, OpenAI’s Library is useful. It is practical. It improves the real workflow of people who use ChatGPT for actual work rather than occasional amusement. And yes, its partial absence from Europe is another reminder that the continent’s governing classes have become exceptionally good at one thing: making tomorrow arrive somewhere else first.
